International law

First, the legal system is a whole made up of all the existing laws of a country. [0↑ 9 △ Small ↓ Say △ Net]

Second, the legal system is a systematic organic whole formed by the classification and combination of legal departments.

Thirdly, the idealization of the legal system requires a complete range of categories, a strict structure, and internal coordination.

Fourth, the legal system is the organic unification of objective laws and subjective attributes.

Characteristic of a legal system

1. The legal system is a system of national laws, including international laws recognized by the country.

2. It is a system of lex lata

3. The unit that constitutes the legal system is the legal department. The legal department is composed of a number of related legal norms. Therefore, legal norms are the most basic component of the legal system.

The socialist legal system with China's characteristics refers to the basic national conditions at the primary stage of socialism in China, consistent with the basic tasks of socialism, with the Constitution as the commander and the basic basis, composed of complete departments, rigorous structure, internal coordination, scientific style, effective adjustment of laws and supporting regulations. It is an organic unified whole that guarantees our country to advance along the road of socialism with China's characteristics. This system is composed of three levels of laws, administrative regulations, and local regulations. It is composed of seven legal departments: the Constitution and laws related to the Constitution, civil and commercial law, administrative law, economic law, social law, criminal law, and litigation and non-litigation procedure law.

From the perspective of the formulation and implementation of laws, there is only one socialist legal system with China's characteristics. The special committees of the National People's Congress, the government departments, and the local governments did not have their own independent "legal systems." These institutions had neither the need nor the possibility of establishing their own independent "legal systems" under or outside the national legal system.

Constitution and constitution-related laws

In 1978, the Third Plenary Session of the Eleventh Central Committee of the Communist Party of China put forward the policy of "there are laws to abide by, laws must be observed, law enforcement must be strict, and lawbreakers must be prosecuted".

Starting in 1979, the National People's Congress stepped up its comprehensive legislative work.

In 1982, the National People's Congress adopted the revised Constitution of the People's Republic of China.

In September 1997, the 15th National Congress of the Communist Party of China clearly stated that by 2010, the goal of forming a socialist legal system with China's characteristics was to be established.

In 2007, the 17th National Congress of the Communist Party of China proposed to improve the socialist legal system with China's characteristics.

In 2008, the Standing Committee of the National People's Congress organized a large-scale legal clean-up to further ensure the formation of the legal system.

In 2010, the socialist legal system with China's characteristics was established. This shows that the formation of the legal system only achieved the goal of the legislative work, and does not mean the end of the legislative task.

On March 10, 2011, Chairman Wu Bangguo announced at the Second Plenary Session of the Fourth Session of the Eleventh National People's Congress that the socialist legal system with China's characteristics had been formed. [1]

As a result, China has fundamentally achieved a historical change from having no laws to relying on to having laws to rely on, and the development of various undertakings has entered the legal track.

Composition Edit

The legal system of China is generally composed of seven parts: the Constitution and constitution-related laws, civil and commercial law, administrative law, economic law, social law, criminal law, and litigation and non-litigation procedure law. It includes three levels of law, administrative regulations, and local regulations.

The Constitution and constitution-related laws are sometimes referred to as "the system of law" in the field of jurisprudence.
