Chapter One General Provisions
Article 1 This Law is enacted for the purpose of maintaining road traffic order, preventing and reducing traffic accidents, protecting personal safety, protecting the property safety and other lawful rights and interests of citizens, legal persons and other organizations, and improving traffic efficiency.
Article 2 All vehicle drivers, pedestrians, passengers, and units and individuals involved in road traffic activities within the territory of the People's Republic of China shall abide by this Law.
Article 3 The road traffic safety work shall comply with the principles of administration according to law and convenience for the masses, so as to ensure the order, safety and smoothness of road traffic.
Article 4 The people's governments at all levels shall ensure that the administration of road traffic safety is compatible with economic construction and social development.
The local people's governments at or above the county level shall meet the needs of road traffic development, formulate road traffic safety management plans in accordance with the laws and regulations on road traffic safety and the relevant policies of the State, and organize their implementation.
Article 5 The public security department of the State Council shall be responsible for the administration of road traffic safety throughout the country. The traffic administrative departments of the public security organs of the local people's governments at or above the county level shall be responsible for the administration of road traffic safety within their respective administrative areas.
The traffic and construction administrative departments of the people's governments at or above the county level shall, in accordance with their respective duties, be responsible for the relevant road traffic work.
Article 6 The people's governments at various levels shall regularly conduct education on road traffic safety to enhance the citizens' awareness of road traffic safety.
When performing their duties, the traffic administrative department of the public security organ and its traffic police shall strengthen the publicity of the laws and regulations on road traffic safety, and set an example in abiding by the laws and regulations on road traffic safety.
State organs, armed forces, enterprises, institutions, social organizations and other organizations shall conduct education on road traffic safety among their own personnel.
The administrative departments of education and schools shall incorporate the education on road traffic safety into the contents of legal education.
The press, publishing, broadcasting, television and other relevant units shall have the obligation to conduct education on road traffic safety.
Article 7 With regard to the administration of road traffic safety, scientific research shall be strengthened, and advanced administrative methods, techniques and equipment shall be popularized and used. [1]
Chapter 2 Vehicles and Drivers
Section 1 Motor Vehicles and Non-motor Vehicles Article 8 The State applies a registration system to motor vehicles. A motor vehicle can only be driven on the road after it has been registered by the traffic control department of the public security organ. If an unregistered motor vehicle needs to travel on the road temporarily, it shall obtain a temporary pass.
Article 9 When applying for the registration of a motor vehicle, the following certificates and vouchers shall be submitted:
Identification of the owner of the motor vehicle;
Certificate of origin of the motor vehicle;
Certificate of conformity of the whole motor vehicle or import certificate of imported motor vehicle;
Proof of payment of vehicle purchase tax or tax exemption certificate;
Other certificates and vouchers that shall be submitted when the motor vehicle is registered as required by laws and administrative regulations.
The traffic control department of the public security organ shall complete the examination of the motor vehicle registration within five working days from the date of accepting the application. If the conditions prescribed in the preceding paragraph are met, the registration certificate, number plate and driving permit shall be released; if the conditions prescribed in the preceding paragraph are not met, the reasons for non-registration shall be explained to the applicant.
Any unit or individual other than the traffic control department of the public security organ shall not release the number plate of a motor vehicle or require a motor vehicle to display another number plate, unless it is otherwise provided for by this Law.
The design of the registration certificate, number plate and driving permit shall be prescribed and supervised by the public security department of the State Council.
Article 10 A motor vehicle approved for registration shall meet the national technical safety standards for motor vehicles. When applying for the registration of a motor vehicle, the applicant shall accept the technical safety inspection of the motor vehicle. However, for a motor vehicle model produced by an enterprise certified by the competent department of motor vehicle products of the state in accordance with the technical safety standards for motor vehicles, if the new model meets the technical safety standards for motor vehicles upon leaving the factory and obtains the certificate of conformity, the safety inspection shall be exempted.
Article 11 When driving a motor vehicle on the road, it shall hang the number plate, place the inspection certificate and the insurance certificate, and carry the driving permit along with the vehicle.
The number plate shall be hung in accordance with the provisions, kept clear and complete, and shall not be intentionally covered or defaced.
No unit or individual may confiscate or detain the number plate of a motor vehicle.
Article 12 Under any of the following circumstances, the corresponding registration shall be made:
The ownership of a motor vehicle is transferred; for a motor vehicle on the road, it shall be registered in accordance with laws and administrative laws;
The contents of the motor vehicle registration are changed;
The motor vehicle is mortgaged; for a motor vehicle on the road, it shall be registered in accordance with laws and administrative laws; for a motor vehicle on the road, it shall be registered in accordance with laws and administrative laws;
The motor vehicle shall be scrapped.
